Fabuly: Podcasts Terms of Use
Last updated: 2026-10-05
These Terms apply to the Fabuly: Podcasts Android and iOS applications. Fabuly: Podcasts is separate from Reader and the Fabuly audiobook application. Features and availability may differ between platforms, devices, and versions.

Accepting these Terms
By accepting these Terms or using Fabuly: Podcasts after they have been made available to you, to the extent permitted by law, you agree to them. Please read them before using the app. If you do not agree, do not use it.
If you use the app on behalf of another person or organization, you confirm that you have authority to accept these Terms for them. Mandatory rights that apply to you are not affected by these Terms.
What Fabuly: Podcasts does
Fabuly: Podcasts lets you discover and follow shows, stream episodes, save episode details, manage a listening queue, and download supported audio for offline listening. It provides playback controls, saved progress, and local browsing and listening preferences. Home can order catalog choices using your library on your device; you can turn that personalization off in Settings.
The app currently requires no account and is free to use. It does not provide a Fabuly cloud library, backup, or synchronization between devices or with our other applications.
Catalog choices, feed details, artwork, and episode audio come from third-party directories and publishers. Availability depends on their services, your location, connectivity, device capabilities, and available storage. A show appearing in the app does not mean that we publish or endorse it.
Eligibility
You must have the legal capacity to accept these Terms. If you are under the age of majority in your country, you need a parent or legal guardian's permission. Follow any applicable app-store age restrictions.
Respect any age restrictions applying to particular content. Explicit-content labels and filters depend on publisher and directory information and may be incomplete or inaccurate.
Your device and local library
Your followed shows, saved episodes, queue, recent listening, progress, preferences, and downloads are stored locally. You are responsible for securing your device. We cannot restore a library that exists only on your device.
Uninstalling the app, clearing its data, resetting or losing your device, or a storage failure can remove local information permanently. Fabuly: Podcasts is not a backup service, and reinstalling the app or changing devices does not retrieve a copy from Fabuly.
Some browsing information and artwork may remain available from a local cache. Cached information can be outdated, and a cached listing is not a guarantee that its audio is available offline.
License to use the app
We grant you a limited, personal, non-exclusive, non-transferable license to use Fabuly: Podcasts for your own lawful, non-commercial use, subject to these Terms and applicable app-store rules.
You may not sell, rent, redistribute, or commercially exploit the app itself without permission. These restrictions do not remove rights granted by the licenses of third-party components or rights that applicable law gives you, including rights to study, modify, or reverse engineer software that cannot lawfully be excluded.
The app's software, branding, and original interface materials belong to Fabuly AI SAS or its licensors. Third-party components retain their respective ownership and license terms.
Podcast content and rights
Podcast episodes, recordings, descriptions, artwork, trademarks, and other publisher materials retain their respective ownership and rights. Availability in a directory or at a public address does not transfer ownership to you or establish permission for every use.
Use content only as permitted by its rights holder, an applicable license, or law. Do not redistribute, sell, publicly perform, or otherwise exploit protected episodes or artwork without the necessary authorization or another lawful basis. Respect applicable source terms, access restrictions, and attribution requirements. These Terms do not grant Fabuly or you rights that a publisher has not granted.
Publishers may change, restrict, or remove their feeds and audio. We do not guarantee permanent availability of a show or episode. Opinions and claims in podcasts are the publishers' responsibility; directory listings and local recommendations do not imply endorsement.
Fabuly: Podcasts currently adds no advertising of its own. Publisher audio may contain advertisements or sponsorships, including advertisements selected by the publisher's delivery services. The app does not promise to remove those advertisements.
Downloads and connectivity
The download feature is for personal offline listening through the app, subject to applicable content rights. Saving an episode adds it to your library; it does not download the audio. Offline playback requires a completed, accessible local download. Not every audio source supports downloading.
Transfers can pause, fail, or restart because of network conditions, publisher changes, available storage, or operating-system restrictions. Background downloads use native platform services, but we do not guarantee that they continue through every interruption, force-stop, or device restart. Check the download status before relying on an episode without a connection.
Removing downloaded audio preserves saved-episode and listening-progress information unless you separately remove that information. A lost, damaged, or removed audio file may need to be downloaded again while the publisher still makes it available.
Streaming, searching, browsing, artwork loading, and downloads use device and network resources. The download mobile-data preference applies to episode downloads, not all app traffic. Your network provider's data and roaming charges may apply.
Acceptable and safe use
You must not use the app to:
- Break the law or infringe copyright, privacy, or other rights.
- Harass, exploit, or harm others, including minors.
- Introduce malware, commit fraud, or attack the app, its providers, or publishers.
- Bypass access controls, digital rights management, security restrictions, or service limits.
- Send excessive or automated traffic that disrupts the app or third-party services.
- Misrepresent the source or ownership of content or remove required rights notices.
Listen at a safe volume. Where compatible car or system controls are available, follow road-safety rules and set up your listening while safely parked. Podcast content is not a substitute for professional advice when making medical, legal, financial, or other important decisions.
Payments and subscriptions
Fabuly: Podcasts currently has no paid subscriptions or in-app purchases. Using it does not subscribe you to Reader or the separate Fabuly audiobook service or change an existing subscription.
If we introduce paid features, their prices and purchase conditions will be presented separately before you make a purchase. No charge is authorized merely by accepting these Terms.
Third-party services and privacy
The app uses Apple's podcast catalog, Podcast Index, publisher feeds and media hosts, third-party software, operating systems, and app stores. Their applicable terms, licenses, and privacy policies may also apply. When using Podcast Index through the app, comply with its applicable Terms of Service, including restrictions on unauthorized reuse of returned content.
The Fabuly: Podcasts Privacy Policy explains local storage, searches sent to directory providers, publisher connections, support correspondence, and your choices and rights. A local library does not mean that browsing or playback makes no external connections. Acknowledging that policy is not consent to unrelated advertising or optional processing.
Feedback and content reports
If you send suggestions or feedback, you permit us to use those suggestions to improve the app without an obligation to compensate you. This does not give us ownership of your library or permission to publish personal information in your correspondence.
Report unlawful content or rights concerns to joseph@fabuly.io, identifying the show or episode, the relevant address, and the reason for your report. We will review sufficiently specific reports and take appropriate action within our control. We do not control copies hosted independently by a publisher.
Changes to the app
We may update, modify, suspend, or discontinue features for technical, security, legal, or operational reasons, including compatibility with changing third-party services. Some features may require an app or operating-system update.
We will provide legally required updates and notices. Material changes remain subject to applicable consumer protections, including any required advance notice and rights to refuse a change or end the affected service without charge.
Termination
You may stop using the app at any time. There is no Fabuly: Podcasts account to close. You can remove downloads and library items through the app and remove remaining application data through your device settings.
We may restrict or end access to network services for a material breach of these Terms, unlawful use, security or safety reasons, or discontinuation, subject to applicable law. Where appropriate, we will explain the reason and give you an opportunity to resolve or contest it. This does not transfer any rights in publisher content to us.
Availability and liability
Interruptions and errors can occur. We do not promise uninterrupted service, compatibility with every device or audio source, complete or accurate third-party information, permanent content availability, or recovery of locally stored data.
Our responsibility is determined by applicable law. Nothing in these Terms excludes or limits liability, warranties, remedies, legal guarantees, or consumer protections that cannot lawfully be excluded or limited. Where applicable law provides remedies for a non-conforming digital service, those remedies remain available.
Consumer rights and complaints
Send complaints to joseph@fabuly.io or our registered office so we can try to resolve them.
Where applicable consumer law provides a right to mediation or another out-of-court dispute process, these Terms do not limit that right or your right to bring a claim before a competent court.
Governing law and jurisdiction
These Terms are governed by French law, subject to any mandatory consumer protections that apply in your country of residence. EU consumers retain any mandatory rights to bring proceedings in their country of residence.
For professional users, the competent courts of Paris, France have exclusive jurisdiction unless mandatory law provides otherwise.
Changes to these Terms
We may update these Terms. The date and version above identify the current text. We will provide appropriate notice of material changes and obtain renewed agreement where required by law. Changes do not remove rights that have already arisen under applicable law.
